1. General Lead Generation and Inquiry

1.1 Inquiry Submission: Submitting a request for a quote, itinerary, or availability check via the forms on the Service ("Get Quote," "Plan My Trip") is an inquiry only and does not constitute a confirmed booking or reservation.
1.2 Consent to Contact: By submitting an inquiry, you explicitly consent to BookwithYTI and its representatives contacting you via phone call, SMS, email, or WhatsApp using the contact information you provided (Name, Phone Number, Email, City) to discuss your travel plans and offer relevant packages.

2.1 Booking Process: All package services are provided by third-party vendors ("Vendors"). Bookings are finalized after direct consultation with a Vendor representative (or a BookwithYTI representative acting as a liaison), where the final itinerary, package inclusions, and price are agreed upon.
2.2 Confirmation: A booking is considered confirmed only upon:
- Receipt of a Non-Refundable Deposit: Payment of a specified initial deposit amount paid directly to the Vendor.
- Issuance of a Final Booking Confirmation/Invoice: The final service provider (Vendor) will issue a formal written confirmation/invoice detailing the booking itinerary, price, and payment schedule. BookwithYTI's role as a lead generator is generally complete upon this handoff.
2.3 Pricing: All prices displayed on the website are starting prices or per-person estimates. The final price and package details are determined by the Vendor and are subject to change based on travel dates, availability, and customization.

3.1 Payments Handled by Vendor: BookwithYTI does not handle or process any payments. All financial transactions, including the payment of the initial non-refundable deposit and the remaining balance, must be made directly to the respective third-party Vendor.
3.2 Initial Deposit: A non-refundable deposit is required by the Vendor at the time of preliminary confirmation. This deposit compensates the Vendor for securing services and is not refundable, regardless of subsequent cancellation.
3.3 Balance Payment: The remaining balance of the total package cost must be paid directly to the Vendor according to the timeline specified in their Confirmation/Invoice.
3.4 Failure to Pay: Failure to pay the balance to the Vendor by the due date may result in the Vendor cancelling the booking, and the initial deposit paid to the Vendor will be forfeited.

4.1 Role of BookwithYTI: BookwithYTI is solely responsible for generating and selling qualified leads to Vendors. We are **not** the direct service provider. Once the Vendor issues the final invoice, they become the responsible party for service delivery and package refund processing.
4.2 Initial Deposit: The initial deposit paid directly to the Vendor is **non-refundable** as per the Vendor's terms and conditions.
4.3 Vendor Cancellation Policy: All policies regarding package cancellation charges, refund timelines, and amounts (including the detailed tiered charges) are determined and executed **exclusively by the final Vendor** who issued your booking invoice. You must direct all cancellation requests and refund inquiries to the Vendor in accordance with their specific terms.
4.4 Service Quality: Responsibility for the quality and delivery of tour services rests entirely with the Vendor.

4.6 Vendor Cancellation: The Vendor reserves the right to cancel a tour. Any refund offered will be governed by the Vendor's policy.

5.1 Itinerary Changes: The final tour operator (Vendor) acts as an agent and uses third-party services (hotels, transport). They reserve the right to modify the itinerary, accommodation, or travel arrangements due to circumstances beyond their control (e.g., weather, road closures, political unrest, or operational requirements). BookwithYTI is not responsible for these operational decisions.
5.2 Client Responsibility: Travelers are responsible for possessing valid identification (e.g., Voter ID, Aadhaar Card for Indian citizens; Passport/Visa for foreign nationals) and adhering to local laws and regulations.
5.3 No-Shows and Mid-Trip Cancellations: No refunds will be provided by the Vendor for no-shows, unused services, or services voluntarily cancelled by the traveler after the tour has commenced, subject to the Vendor's full policy.

6.1 Disclaimer: BookwithYTI, as a lead generation service, shall not be responsible for any injury, loss, damage, accident, delay, or expense incurred by the traveler, arising directly or indirectly from any act or omission of the **final Vendor or any third-party supplier** (e.g., hotel, airline, transport operator) or from Force Majeure events.
6.2 Liability Cap: As BookwithYTI does not collect any payments for the package services, our liability, in any case, is strictly limited to the maximum extent permitted by law for the usage of this platform and the provision of lead generation services. BookwithYTI bears no liability for any package costs paid to the Vendor.

7.1 Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.
7.2 Disputes: Any disputes arising out of or relating to these Terms or the services provided shall be subject to the exclusive jurisdiction of the courts located in Darjeeling.
